​These Terms of Service (“Terms”) form an integral part of the User Agreement, constituting a legally binding contract that governs your use of our platform. While it’s essential to read these Terms in their entirety, here are key highlights for your quick understanding:​

When utilising the Services, including content posting, adherence to both this User Agreement and Applicable Law is mandatory: Your responsibility extends to both your use of the Services and the content you generate. You must comply with this User Agreement, its incorporated policies, and all applicable laws.​

You are required to adhere to the acceptable use terms of the Services: Access to the Services should only occur through the presently available and officially provided interfaces. This explicitly prohibits actions such as scraping the Services, attempting to circumvent imposed technical limitations, or engaging in activities that may disrupt the normal operation of the Services.​

We possess extensive enforcement rights: Touchline Tracker retains the authority to enforce actions in response to violations of these terms. This may include, but is not limited to, actions such as removing your Content, limiting visibility, discontinuing your access, or pursuing legal action. Additionally, we reserve the right to suspend or terminate your account for reasons including but not limited to, safeguarding issues and potential legal exposure.

The Terms include Intellectual Property Licenses:
 While you maintain ownership and rights to the Content you post or share, you grant us a comprehensive, royalty-free license to make your Content accessible globally and to enable others to do the same. In turn, we provide you with a license to utilise the software integral to the Services, such as the Touchline Tracker mobile application, exclusively for the purpose of facilitating your use and enjoyment of the Services.​

Your use of the Services is undertaken at your own risk: We offer the Services on an “AS IS” and “AS AVAILABLE” basis, and we disclaim all warranties, responsibilities, and liabilities to you or others as permitted by law. While we have implemented rigorous measures to uphold a platform free from offensive or harmful content, we depend on the community to report any inappropriate materials. The Services are subject to change, and we reserve the right to restrict or terminate access to the Services or specific features for you or other users at any time.​

You are entitled to remedies and redress mechanisms, but it’s important to note that our liability is limited: You have the right to terminate this agreement at any time by deactivating your account and ceasing use of the Services. Please be aware that we shall not be liable for specific types of damages as outlined in the agreement. Additionally, if you suspect that your Content has been copied in a manner constituting copyright infringement, the reporting process is elaborated in these Terms.​

Kindly note that these Terms encompass our Privacy Policy (https://touchline.tracker.co.uk/privacy) and additional terms relevant to your use of the Services and your Content. Please be aware that variations in these terms may occur based on your location. Nevertheless, it is a prerequisite that you are at least 16 years old to use Touchline Tracker, or you have the consent of your parent/guardian.

By entering the competition, you agree to adhere to both our overarching Terms of Service and these Monthly Competition Terms. If you have any inquiries, our support team is here to assist you.

1. Who May Use the Services

You may access and use the Services only if you consent to enter into a binding agreement with us and are not prohibited from receiving services under the laws of your jurisdiction. In any circumstance, you must be at least 16 years old to utilise the Services, or you must have obtained the consent of your parent/guardian.

3. Content on the Services

You bear responsibility for your utilisation of the Services and any Content you contribute, ensuring adherence to applicable laws, rules, and regulations. Only share Content that aligns with your comfort level in sharing with others.​We maintain ongoing surveillance of the content on our platform while also depending on our community to flag inappropriate material. By using the Services, you acknowledge the possibility of exposure to Content that could be considered offensive or inappropriate prior to our ability to remove such content. It’s essential to recognise that the responsibility for all Content lies solely with the person who created it.​We reserve the right to remove Content that violates the User Agreement, including for example, copyright or trademark violations or other intellectual property misappropriation, impersonation or unlawful conduct.

4. Your Ownership and Grant of Rights in the Content

You maintain full ownership rights to any Content you submit, post, or display on or through the Services. Your Content, including incorporated audio and videos, remains yours.​By submitting, posting, or displaying Content on or through the Services, you grant us a global, non-exclusive, royalty-free license (with the right to sublicense) to utilise, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such Content.​Additionally, you acknowledge that this license incorporates the right to analyse the text and other information you provide to enhance the Services. These uses incur no compensation to you, as your use of the Services is considered adequate compensation for the granted rights and Content.­You affirm and warrant that you possess, or have obtained, all necessary rights, licenses, consents, permissions, power, and/or authority to grant the rights specified herein for any Content you submit, post, or display on or through the Services. You further confirm that such Content does not violate copyright or other proprietary rights, unless you possess the requisite permission or legal entitlement to post the material and grant us the aforementioned license.

5. Using the Services

Please take a moment to review our Rules and Policies, integral components of the User Agreement that delineate prohibited conduct on the Services. Your use of the Services should strictly align with these Terms and all relevant laws, rules, and regulations. Touchline Tracker implements enforcement actions in response to Content or user behaviour that contravenes our Rules and Policies or involves sensitive media.​The Services undergo constant evolution, and, consequently, may undergo changes at our discretion. We retain the right to cease providing the Services or specific features either permanently or temporarily, at our sole discretion. Additionally, we may establish usage and storage limits at any time. We reserve the authority to remove or decline distribution of any Content on the Services, limit its visibility, suspend or terminate user accounts, and reclaim usernames as deemed appropriate. This may occur for reasons including, but not limited to: (i) safeguarding the Services or our users; (ii) compliance with applicable laws or orders from competent authorities; (iii) violation of these Terms or our Rules and Policies or infringement of third parties’ intellectual property or other rights; (iv) if you or your Content exposes us, other users, or any third party to legal or regulatory risk; and/or (v) prolonged inactivity.​In acknowledgment of our granting you access to and use of the Services, you consent to us and our third-party providers and partners placing advertising on the Services or in connection with the display of Content or information from the Services, whether submitted by you or others. We also reserve the right to access, read, preserve, and disclose any information we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process, or governmental request; (ii) enforce the Terms, including the investigation of potential violations; (iii) detect, prevent, or address fraud, security, or technical issues; (iv) respond to user support requests; or (v) protect the rights, property, or safety of Touchline Tracker, its users, and the public. Rest assured, we do not disclose personally-identifying information to third parties except in accordance with our Privacy Policy.”

6. Your Account Management

To access the Services, you are required to establish an account. It is your responsibility to secure your account by using a robust password and restricting its use solely to this account. We cannot and will not be held liable for any loss or damage resulting from your failure to adhere to these security measures.​You have substantial control over most communications emanating from the Services. While you may regulate various communications, certain messages such as service announcements and administrative notices are essential and integral to the Services and your account. Opting out of these messages may not be feasible.​If you have linked your phone number to your account and subsequently modify or deactivate that number, it is imperative to update your account information. This ensures that we do not inadvertently communicate with anyone who gains access to your old number. Your proactive action in maintaining accurate account details is crucial in this regard.

7. Your License to Use the Services

We grant you a personal, UK wide, royalty-free, non-assignable, and non-exclusive license to utilise the software provided as part of the Services. This license serves the singular purpose of enabling you to use and derive benefit from the Services as presented on Touchline Tracker, in accordance with the permissions outlined in these Terms.​The Services are safeguarded by copyright, trademark, and other laws in the United Kingdom. These Terms do not confer upon you the right to use the Touchline Tracker name or any Touchline Tracker trademarks, logos, domain names, distinctive brand features, or other proprietary rights. All rights, title, and interest in and to the Services (excluding Content provided by users) are and will remain the exclusive property of Touchline Tracker and our licensors. Any feedback, comments, or suggestions you voluntarily provide concerning Touchline Tracker or the Services will be utilised at our discretion, without any obligation to you, and you relinquish any claims to such feedback, comments, or suggestions.

8. Prohibited Use of the Services

You agree not to misuse the Services, which includes actions such as interfering with them or accessing them in a manner inconsistent with the interface and instructions provided by us. Additionally, you commit to refraining from circumventing any technical limitations in the software integral to the Services, as well as from reverse engineering, decompiling, or disassembling the software, unless expressly permitted by applicable law.While using the Services, you must avoid engaging in the following activities:​(i) accessing, tampering with, or utilising non-public areas of the Services, our computer systems, or the technical delivery systems of our providers;

(ii) probing, scanning, or testing the vulnerability of any system or network, or breaching or circumventing any security or authentication measures;
(iii) accessing or searching the Services through any means other than our currently available, published interfaces provided by us, unless specifically allowed in a separate agreement with us (Note: crawling or scraping the Services in any form, for any purpose without our prior written consent is expressly prohibited);
(iv) forging any TCP/IP packet header or any part of the header information in any email or posting, or using the Services to transmit altered, deceptive, or false source-identifying information;
(v) engaging in conduct that we deem platform manipulation, spam or a breech of our Rules and Policies.
(vi) interfering with or disrupting (or attempting to do so) the access of any user, host, or network. This includes activities such as sending viruses, overloading, flooding, spamming, mail-bombing the Services, or scripting the creation of Content in a manner that interferes with or burdens the Services.Facilitating or assisting others in violating these Terms, including the distribution of products or services encouraging such violations, is also considered a violation of these Terms.

9. Ending These Terms

You have the right to conclude your legal agreement with us at any time by deactivating your accounts and ceasing your use of the Services.Conversely, we reserve the right to suspend or terminate your account or discontinue providing all or part of the Services if, based on our reasonable judgment:

(i) You have contravened these Terms or our Rules and Policies;
(ii) Your actions pose a risk or potential legal exposure for us;
(iii) Removal of your account is warranted due to unlawful conduct;
(iv) Removal of your account is necessary due to prolonged inactivity; or
(v) Our provision of the Services to you is no longer commercially viable.
In such instances, we will make reasonable efforts to notify you, either through the email address linked to your account or the next time you attempt to access your account, depending on the circumstances.​Should you believe that your account was terminated in error, you have the option to file an appeal by contacting [email protected].It is important to note that these Terms endure even after the deactivation or termination of your account.

10. Liability

Through your use of the Services, you acknowledge and agree that the liability of Touchline Tracker Ltd., its parents, affiliates, related companies, officers, directors, employees, agents, representatives, partners, and licensors is limited to the maximum extent permitted by the laws of your country of residence.

11. General

We may update these Terms periodically. Any alterations will not apply retroactively, and the most recent version of the Terms, available at touchlinetracker.com/tos, will govern our association with you. Unless the changes are for new functionalities or legal necessities, we will provide a 30-day advance notice before implementing alterations that affect the rights or obligations of any party to these Terms. This notice may be communicated through a service notification or an email sent to the address associated with your account. If you continue to access or use the Services after the revised Terms come into effect, you are accepting and bound by the updated Terms.
